Acceptable Use Policy
This Policy sets out what B64 — Base64 Image Converter may and may not be used for.
1. Status and incorporation
This Acceptable Use Policy (the “Policy”) forms part of the Terms of Use and End User License Agreement for B64 — Base64 Image Converter. Terms defined there have the same meaning here.
2. Acceptance
By using the App you agree to this Policy. If you do not agree, do not use the App.
3. Definitions
Content means any image, document, Base64 payload or other file you read into, produce with, or write from the App. Process means to encode, decode, batch-convert, preview, copy, export or save Content using the App.4. Intended uses
The App is intended for lawful conversion of images and documents you own or are authorised to handle. Typical uses include preparing assets for web pages, stylesheets, email templates and documentation; embedding images in configuration or payload formats; recovering images from payloads sent to you; and verifying file integrity with checksums.
5. Prohibited conduct
You must not use the App to Process Content that:
- depicts the sexual exploitation or abuse of children, or is otherwise unlawful to possess, produce or distribute in your jurisdiction;
- you do not own and are not authorised to copy, convert or distribute, including material obtained through unauthorised access to a computer system;
- constitutes or facilitates malware, an exploit payload, or any mechanism intended to damage, disable or gain unauthorised access to a system;
- is used to impersonate a person or organisation, or to fabricate a document, receipt, identification or record intended to deceive;
- infringes the intellectual property, privacy or publicity rights of another person;
- is processed in furtherance of harassment, stalking, fraud, extortion or any other unlawful act.
You must also not attempt to circumvent the App's purchase or entitlement mechanisms, or to use the App in violation of the Apple Media Services Terms and Conditions.
6. What we can and cannot do
The App performs all conversion locally and transmits nothing. We therefore have no visibility into what anyone Processes with it, no ability to inspect Content, and no technical mechanism to detect or prevent a breach of this Policy. That is a deliberate privacy property, and it means the obligations in this Policy are yours to honour.
What we can do is decline support, and report matters to the appropriate authorities or to Apple where we are required or permitted to do so.
7. Cooperation with authorities and with Apple
We will cooperate with lawful requests from competent authorities and with Apple in accordance with applicable law. Because we hold no user content and no user records, our ability to assist with any such request is limited to information we actually possess, which in practice is nothing about you.
8. Notice and action
If you believe the App is being used in breach of this Policy in a way we can act on, write to help@mahtca.com with a description of the conduct, the identity of the material or party concerned if known, and your contact details. We will review every report we receive.
9. Reporter safe harbour
We will not pursue a good-faith reporter for making a report under this Policy. Reports made in bad faith, or that are themselves abusive, may be disregarded.
10. Consequences of breach
Breach of this Policy is a breach of the Terms and may result in termination of your licence. It may also expose you to civil or criminal liability under applicable law, which is a matter between you and the relevant authorities rather than between you and us.
11. Reservation of rights
We reserve every right not expressly granted, including the right to refuse support and to update this Policy.
12. No third-party beneficiary rights (except Apple)
This Policy creates no rights for any third party, except that Apple and Apple's subsidiaries are third-party beneficiaries as described in the Terms.
13. Survival
Provisions that by their nature should survive termination of the Terms, including this Policy's prohibitions and the consequences of breach, survive.
14. Severability
If any provision of this Policy is held unenforceable, the remainder continues in full force.
15. Governing law and forum
This Policy is governed by, and disputes under it are subject to, the governing law and forum provisions of the Terms.
16. Changes
We may revise this Policy. The current version is always published here with a version number and effective date.
